General terms and conditions
ARTICLE 1 - GENERALITIES :
The products of the LUCANGELI brand are the property of LUCIA DI OLIO SAS, with a share capital of 1000 euros, whose head office is located at 41 avenue daumesnil, 94160 Saint-Mandé, registered with the Créteil Trade and Companies Register under the SIRET N° 890 548 852 - VAT N° FR12890548852 - APE 4791B hereinafter "LUCIA DI OLIO SAS". These General Terms and Conditions of Sale (hereinafter "GTC") apply exclusively to all sales by LUCIA DI OLIO of products or services made to any individual or legal entity acting for the satisfaction of their personal needs or acting in the context of their professional or commercial activity (hereinafter "Customer"). All other conditions are only binding on LUCIA DI OLIO SAS after written confirmation by LUCIA DI OLIO SAS. Any document other than the present GTC, in particular catalogues, advertisements, price lists, handwritten notes, is only informative and indicative, not contractual, and may be modified by LUCIA DI OLIO SAS without notice. At the time of placing an order, the customer acknowledges having read and accepted without reservation the present general conditions of sale.
ARTICLE 2 - PRICES :
The prices of our products are indicated on the site in euros, including all taxes, but excluding the cost of processing and shipping. LUCIA DI OLIO SAS reserves the right to modify its prices at any time. When an order is placed, the products will be invoiced on the basis of the prices in force at the time the order is validated. The products remain the property of LUCIA DI OLIO SAS until the price has been paid in full.
ARTICLE 3 - PROCESSING AND SHIPPING COSTS :
The products are delivered to the delivery address indicated during the ordering process. Deliveries in France are made by a suitable carrier. No minimum order amount is required, but delivery charges will be invoiced for any order of an amount lower than the free delivery conditions. Deliveries are made carriage paid for all shipments of an amount greater than 30 euros in Metropolitan France and 55 euros internationally.

ARTICLE 5 - VALIDATION OF ORDERS :
Validation by the Customer
You declare that you have read and accepted these General Terms of Sale before placing your order. The validation of your order therefore implies acceptance of these General Conditions of Sale. For orders placed directly on our website or by telephone if you have left us an e-mail address, you will receive an e-mail confirming your order.
In the absence of proof to the contrary, the data recorded by LUCIA DI OLIO SAS constitutes the proof of all transactions between LUCIA DI OLIO SAS and its customers.
Validation by LUCIA DI OLIO SAS
Upon receipt of orders, LUCIA DI OLIO SAS ensures the consistency of the data communicated. As part of its policy to fight against fraudulent payments, LUCIA DI OLIO SAS reserves the right to carry out any necessary investigation before the validation of an order. This may include requesting proof of address or the details of your bank branch. When such a procedure is launched, the validation of the order is suspended. If the order is not validated within 14 days, the order will be cancelled and the sums paid refunded. This period may be extended if there are ongoing exchanges of documents between the customer and LUCIA DI OLIO SAS.
ARTICLE 6 - AVAILABILITY :
Our product offers are valid as long as they are visible on the site, within the limits of available stocks. In the event that a product is not available after you have placed your order (stock error, product breakage), we will inform you by e-mail or telephone. We will then offer you a refund of the missing product(s) by credit card within 14 working days of the customer's decision, either by cheque or by bank transfer.
ARTICLE 7 - DELIVERY :
The products are delivered to the delivery address you indicated during the ordering process. Deliveries are made by a suitable carrier selected by LUCIA DI OLIO SAS.
For payments by credit card, orders are shipped within 5 days of their online validation.
ARTICLE 8 - DELIVERY TIMES :
The delivery times indicated here are valid under normal service conditions and for shipments made by our usual carriers.
If the processing of your order (in particular because of the weight of the packages) requires a particular routing solution, the delivery times will be specified to you when you place your order. If you are not satisfied with these times, you may cancel your order. Similarly, in the event of a strike by road hauliers, (more generally any social disturbance), or climatic incidents, delivery times may be extended. These delivery times apply to deliveries in Metropolitan France, on working days, excluding postal delivery problems and depending on product availability.
ARTICLE 9 - DELIVERY DEADLINES :
The deadlines indicated in article 8 are the delivery deadlines usually observed. We undertake to deliver orders to France within a maximum of 15 days following receipt of payment.
ARTICLE 10 - PAYMENT :
The payment of your purchases is made in cash:
- either on our site by credit card: Visa, MasterCard, Carte Bleue, American Express. Payments are secured by the Stripe solution in conjunction with our bank QONTO.
No delay in payment is granted and orders are not sent until payment has been received and cashed.
The discount codes are only applicable to the value of the products, which must be at least the value of the voucher, and cannot include shipping costs. This offer cannot be combined. Discount codes are not retroactive and cannot be applied once the order has been placed. The discount codes for free products are valid within the limits of available stock. Discount codes are valid until their expiry date.
ARTICLE 11 - COMPLAINTS AND AFTER-SALES SERVICE :
You have a period of 14 working days from the receipt of your products to exercise your right of withdrawal from LUCIA DI OLIO SAS without having to justify your reasons or pay any penalty.
If you exercise your right of withdrawal within the above-mentioned period, we ask you to contact us at firstname.lastname@example.org . We will reimburse you for the product(s) concerned within a maximum of 14 days from the date of the return request. The buyer is responsible for the shipping and return costs. The means of return is up to the customer. Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.): LUCIA DI OLIO SAS - 41 Avenue Daumesnil, 94160, Saint-Mandé. We cannot accept returns of products that have been opened or whose packaging has been damaged. No returns or replacement products will be accepted for fresh products or for any products after the expiry of the use-by date. If these products are nevertheless returned, they will not be refunded in any form whatsoever.
Packages delivered after the deadline
In the event of non-compliance with the delivery deadlines, the customer has the possibility of cancelling the contract and may request reimbursement of the products ordered as well as the delivery costs. LUCIA DI OLIO SAS will inform the customer as soon as possible of any delay and undertakes to reimburse the customer for the full amount of the order (products and shipping costs) in the event of packages delivered late.
Return of parcels
In case of return of a parcel, the address provided by the customer was wrong or the parcel was put on hold. The carrier will return the package to us. We will notify you as soon as possible. A second shipment may be made subject to the payment by the customer of a 12 euro shipping fee. If the customer prefers to cancel the order, it will be reimbursed, excluding shipping costs.
Lost / non-arrived parcels
In case of loss of a parcel (the carrier has lost the parcel during delivery and the customer has never been delivered), LUCIA DI OLIO SAS undertakes to send a second parcel at its expense.
Defective or damaged products
LUCIA DI OLIO SAS will proceed to all useful verifications and will, if necessary, ask the customer for any useful information or photos. Following this, LUCIA DI OLIO SAS may respond favourably or unfavourably to the customer's requests. If the response is favourable, we undertake to reimburse you or exchange the apparently defective, damaged or damaged products (the cost of re-sending the products is borne by LUCIA DI OLIO SAS).
In this case, please contact us at email@example.com to describe the problem precisely. No return or replacement of the product will be accepted after a period of 14 working days following the date of receipt of your complaint.
Order preparation errors

ARTICLE 12 - REFUNDS :
Refunds of products in the cases referred to in Article 10 will be made as soon as possible and at the latest within 14 days of the date on which the right was exercised.
ARTICLE 13 - APPLICABLE LAW - DISPUTE :
This contract is subject to French law. The language of this contract is French. In the event of a dispute, the French courts shall have sole jurisdiction.
ARTICLE 14 - RIGHT OF ACCESS AND RECTIFICATION :
You have the right to access and rectify all data concerning you in accordance with the law defined by the Commission National Informatique et Liberté (CNIL). It is also brought to the attention of the users of the site www.lucangeli.fr that LUCIA DI OLIO SAS transmits non-personal data to an authorised third party (Google, ...) through the use of third party cookies for the purpose of collecting and using navigation data of the users of the site www.lucangeli.fr.
